Terms of Service

Hey. I want to keep this as straightforward and fair as possible. This is a free hosting project run by one person in their spare time. By creating an account on atzenix.com, you agree to the points below. These rules exist so the server stays usable for everyone. not to trap you in legal jargon.

1. The Reality of the Infrastructure

This platform mostly serves free hosting — that is the point of it. It runs on infrastructure rented from reputable hosting companies, and the base will keep being upgraded as the platform grows, up to dedicated servers. But no matter the hardware underneath: a free service operated by one person comes with the realities of free hosting. There is no uptime guarantee and no SLA of any kind — no compensation for downtime, and no contractual availability. I monitor the platform and fix issues as quickly as I can (up.atzenix.com shows live status), but you should not host anything mission-critical on the free tier. If your project needs an availability promise, it needs a commercial host.

Paid web hosting (Waypro) is hosted through generally known hosting brands that allow me to guarantee reasonable uptime with expected results. For all tiers, I cannot guarantee 100% uptime or permanent availability. I will do my best to keep things online — but the free tier is provided as described above: best effort, no promises.

2. Your Data is Your Responsibility

I do not run automated backups on my end. If the server disappears tomorrow, your data disappears with it. You are solely responsible for keeping local backups of your websites, databases, and files. By using this service, you agree that I am not liable for any data loss, corruption, or downtime.

3. Provisioning & Monitoring

Orders are reviewed and activated manually by staff before anything goes live. As part of the review, staff may look at your account context — your other packages, recent support tickets and recent account activity — solely to screen the order for abuse. Once approved, activation runs automatically and normally completes within a minute; you will receive an email when the package is ready. To prevent abuse and keep things clean, I actively monitor all freshly activated accounts. This includes automated and manual checks on initial file uploads, DNS configurations, and resource usage during the early stages of your account's life. This monitoring is strictly for security, abuse prevention, and ensuring compliance with the Acceptable Use Policy (AUP).

The in-house panel does not provide per-site CPU or RAM monitoring, so I cannot see exactly how much each account consumes. I ask that you be mindful of the resources your site uses. If your site is noticeably affecting server performance, or if I suspect it conflicts with the AUP, I will reach out. Otherwise, it is your responsibility to monitor your own usage and request changes if needed.

4. Acceptable Use

This is a shared box. You can host personal sites, portfolios, small blogs, and light client projects. You cannot host things that ruin the box for everyone else or put anyone legally at risk.

5. How Violations Are Handled

I'm not looking to ban people over honest mistakes. For non-obvious abuse cases. like a plugin going rogue and spiking CPU, or accidentally hosting something borderline. my default approach is to reach out to you first. I'll open a ticket, explain the issue, and see if we can fix it together before lifting any temporary suspension.

However, for obvious spammers, blatant abuse, phishing, and malware, the account will be suspended immediately and permanently without warning. There's no time or patience to negotiate with bad actors.

6. Resource Limits

Each package comes with its own set of limits — disk space, monthly bandwidth, domains, subdomains, mailboxes and databases — as shown on the order page. Under reasonable circumstances, limits can be increased upon request through a support ticket. It is your responsibility to monitor your own usage in the panel.

Your website files, databases and any mailbox storage count toward your package's disk space. If you outgrow your package, you can request an upgrade at no additional cost — increases are granted when the use case justifies them, through a support ticket.

Bandwidth is metered per cycle. If a package exceeds its monthly allowance, it pauses until the start of the next cycle and you are notified by email. A limit increase or earlier restoration can be requested through a ticket at no cost. Uploads through the panel file manager are capped at 32 MB per file; use SFTP for larger files.

7. Account Security & Credentials

You are responsible for keeping your panel password and your package credentials (master SFTP account, extra FTP accounts, mailbox passwords) confidential, and for all activity performed through your account. The operator is not liable for consequences of credentials compromised through your own devices or conduct. Where the panel offers additional protections such as two-factor authentication, using them is at your discretion unless the operator requires otherwise.

8. Account Termination

You may close your account at any time. I reserve the right to terminate or suspend any account at my discretion, particularly if it violates the acceptable use policy or threatens the stability of the server. Account termination results in the immediate removal of all hosted content (files, databases, mailboxes, DNS zones). No backups are retained or available after termination. Logs and account metadata on the billing area follow the retention windows described in the Privacy Policy. Banned accounts are subject to the abuse-retention clause there: only the email address and last known IP are kept, solely to prevent ban evasion and to handle abuse reports; everything else is erased. Non-banned accounts may request full deletion at any time (right to be forgotten), which removes all data without such retention. policy outlined in the Privacy Policy.

9. No Warranties

The service is provided "as is" and "as available" without any warranties of any kind. There is no guarantee that the service will be uninterrupted, error-free, or secure. Use it at your own risk.

10. Changes to These Terms

These terms may be updated at any time without advance warning. It is your responsibility to check this page periodically for changes. I will try my best to notify you of major updates through the dashboard or status page, but no guarantee of advance notice is made. Continuing to use the service after changes take effect means you accept the new terms.
